The Director of Public Prosecutions has ordered the prosecution of Bomet Governor Hillary Barchok and former Bungoma Governor Wycliffe Wangamati on corruption-related charges.

The directive follows recommendations from the Ethics and Anti-Corruption Commission (EACC) on allegations of conflict of interest and embezzlement of public funds.

“Upon thorough review, I have directed that Hillary Kipngeno Barchok be charged as follows: Conflict of Interest contrary to section 42(3) as read with section 48 of The Anti-Corruption and Economic Crimes Act 2003, and unlawful acquisition of public property,” read a statement by DPP Renson Ingonga. 

Governor Barchok is to be prosecuted alongside Evans Kipkoech, the Director of Chemasus Construction, who is accused of acquisition of proceeds of crime.

Wangamati has been accused of embezzlement of funds amounting to Sh70million through private companies.

“I have directed that the following individuals be charged as follows: Wycliffe Wangamati for conflict of interest, Michael Wangamati, Nicholas Wangamati, Edward Wangamati and Nabwala Construction Limited for acquisition of proceeds of crime,” added the DPP.

Marsabit Governor Mohamed Mohamud Ali is also trapped in the fraud net, and will be prosecuted for allegedly colluding with other companies to win a tender worth Sh728 million.

The DPP has further directed an investigation on Kiambu Governor Kimani Wamatangi on allegations of irregularity in procurement in awarding tenders worth Sh230 million.

Wamatangi to be investigated alongside his spouse, Anne Waruguru, Charles Kiarie, Mary Wambui, Joseph Kiman, Anne Njoroge and Faith Wambui.

The DPP has further directed that the inquiry file be resubmitted to the EACC for further investigation. 

Last week, the EACC announced it was investigating four sitting governors and 11 former governors over corruption-related offences, including embezzlement, conflict of interest, money laundering, and possession of unexplained wealth.

EACC Chief Executive Abdi Mohamud said the commission had completed investigations into 89 high-profile cases in the past eight months. “These files have been submitted to the Office of the Director of Public Prosecutions with recommendations to prosecute 82 of them. Notably, four involve sitting governors, former county governors, two former Cabinet secretaries, a principal secretary, and CEOs and managing directors of various state corporations.” 

He added that investigations were also underway targeting five current governors and 11 former governors. 

Mohamud said the commission is pursuing cases worth about Sh1.6 billion involving 822 county officials accused of irregular recruitment, payroll manipulation, improper allowances, and misuse of county mortgage and car loan funds.
