Kikuyu benga musician Samuel Muchoki alias Samidoh, has been sued by a woman who accuses him of rape while he was in the United States of America (USA) in 2021.

The woman, codenamed MRW, in her case filed on Tuesday before High Court Judge Lawrence Mugambi, also sued the Inspector General of Police, the Director of Criminal Investigations, the Director of Public Prosecution, the Attorney General and Witness Protection Agency claiming that they had failed to act on her complaint against Samidoh.

Her lawyer, Sunday Memba Mayama alleged that she continues to suffer as her rights are being violated.

He further claimed that the digital evidence might be tampered with or lost, and that the former police officer might interfere with or intimidate her and the witnesses she intends to call against him.

“The subject of the petition is a sexual offence apparently committed by the Interested Party, a Kenyan citizen, abroad, which by operation of section 41 of the Sexual Offences Act, No. 3 of 2006, is triable in Kenya as if committed within its territory. Delay in action by the Respondents undermines the Petitioner’s protection under the Constitution and frustrates enforcement of the statute,” argued Memba.

According to the lawyer, MRW has preserved audio recordings containing the singer’s alleged admissions.

He said that the longer the action is not taken against Samidoh, the greater the risk of the same being tampered with or deleted.

According to him, the security agencies are quiet despite a formal complaint against him being filed.

In her supporting affidavit, MRW claimed that on November 28, 2021, while Samidoh was in the USA for a music performance, he allegedly lured her into his Airbnb in Overland Park Kansas and raped her.

“ I resisted and pleaded with him to stop, but he mocked my protestations, ignored my pleas, and without my consent whatsoever committed the horrific sexual offence,” she claimed.

According to her, between 2021 and 2023, the singer allegedly maintained communication that allegedly bordered on pretentious friendliness and explicit threats.

She stated that in one instance, when she allegedly informed him about the incident, he termed her a ‘professional prostitute.’

“ I reported the offence to the Overland Park Police Department in Kansas, where a case was recorded as Case No. 2023022021 under the classification of rape. I underwent therapy and psychological support following the assault. On June 5, 2025, my therapist issued a letter confirming trauma-related sequelae consistent with sexual assault,” she claimed.

MRW added that in November 2023, she reported to the Kansas District Attorney’s Office, but the case has not proceeded to trial or conviction.

She further said that in June this year, she complained with the Directorate of Criminal Investigation about the same issue.

Nevertheless, she alleged that the police had failed to register, investigate, or pursue her complaint, or to take reasonable steps to secure evidence from the United States.

She wants the court to force the DCI to secure all the evidence she has. At the same time, she is seeking orders barring Samidoh from contacting or reaching out either by himself, friends, associates, family or colleagues.

MRW is also asking the court to order witness protection agency to conduct an assessment and take protective measures.

“Unless this Honourable Court intervenes urgently, there is a real risk that I will continue to suffer violation of my rights, that critical evidence will be lost, and that I will remain exposed to harassment and intimidation by the interested party,” she claimed.
