Accident victim awarded Sh223,000 over reckless Chania Genesis driver

Accident victim awarded Sh223,000 over reckless Chania Genesis driver

A court in Makindu, Makueni county, has awarded a woman Sh223,000 for injuries sustained in an accident involving Chania Genesis bus in 2025.

Senior Principal Magistrate Yusuf Shikanda awarded Alice Mwangeka the said money after finding the bus driver and owner liable for reckless driving.

Mwangeka sued Chania Genesis, its driver, Samuel Karue, and the bus owner Mwaura Nduruhu for reckless driving that caused the accident on November 23, 2025, at Kenani along Nairobi-Mombasa road. 
The magistrate determined that the driver was solely culpable and negligent as far as the accident was concerned.

“Mwangeka’s evidence consistently explained the accident and remained unshaken during cross-examination. Considering the evidence, Karue’s acts of omission and commission would likely have prevented the accident,” Shikanda said.
According to a medical report, Mwangeka suffered blunt injuries to the forehead, neck, left hand, right shoulder, and lower back.

“There is sufficient evidence to prove that the plaintiff sustained injuries because of the accident. The defendants are 100 percent liable for the accident, so I find the plaintiff entitled to damages against them,” said Shikanda.

According to Mwangeka, the driver so negligently, recklessly, and carelessly drove the said motor vehicle and rammed into an oncoming motor vehicle, whereby she sustained serious injuries, loss, and pain.
She blamed the driver for overspending the bus carelessly and failing to slow down, brake, swerve, or act in any other reasonable manner to avoid the said accident.

Mwangeka accused the driver of failing to keep a proper lookout for other road users and driving in a zig-zag manner on the wrong side of the road.
However, Nduruhu denied that his bus was ever in an accident and that Mwangeka was a passenger aboard the bus.

Karue also denied being the driver of the said bus, and the one behind the wheel on the tragic day.

Nduruhu said if the accident occurred, Mwangeka solely caused and substantially contributed to it by her own negligence. 
The bus owner blamed Mwangeka for failing to take adequate precautions for her own safety and to heed the instructions on safety precautions when traveling.

They further said she failed to heed the traffic rules and regulations when traveling by not wearing a seat belt.

Nduruhu said if the accident occurred, then the same was beyond their control.
